Name

Our official name is Jacob's Ladder Neurodevelopmental Learning Center, Inc, DBA Jacob's Ladder School & Therapy Center (also known as Jacob's Ladder Center in the terms below.)

You Agree to These Terms by Using this Site

Your access to, and use of, this Website (collectively referred to as the "Site") is subject to the following Terms of Use and all applicable laws and regulations. By accessing and using the Site, you accept, without limitation or qualification, these Terms of Use, and acknowledge that any other agreements between you and Jacob's Ladder Center are superseded with respect to this subject matter. If you do not agree and accept, without limitation or qualification, these Terms of Use, you must exit the site immediately, not use the files herein, and/or not subscribe to this service.

Limitations of Use

The information and materials on this website are provided for general informational purposes. You may use this site solely for the purpose of learning about and/or purchasing Jacob's Ladder Center services and products, or for your personal use of any tools and downloads available on this site. You may not use, reproduce or distribute the text, graphics, downloads, tools or any other content on this website for any commercial, non-commercial or any other purpose not outlined in this agreement.

Privacy

Any personal data (for example, your name, address, telephone number or e-mail address) you transmit to the Site by electronic mail or otherwise will be used by Jacob's Ladder Center in accordance with the Jacob's Ladder Center Privacy Policy. Any other communication or material you transmit to the Site, such as questions, comments, suggestions or the like, will be treated as non-confidential and nonproprietary.

Pricing and Recurring Donations

You agree to provide accurate, current, and complete information as required for the purchase of products and donations. Jacob's Ladder Center reserves the right to block further sales to anyone who provides false, inaccurate or incomplete data. You acknowledge that Jacob's Ladder Center uses a third party payment processing service to process orders and bill fees to your credit card.

Pricing for products including, without limitation, donations (including any applicable shipping and handling fees) can be found on Jacob's Ladder Center's then-current pricing page located on each product page and in your cart (when items are added to your cart). Jacob's Ladder Center reserves the right to change prices for products at any time, and does not provide price protection or refunds in the event of promotions or price decreases.

You agree to pay all fees charged to your account based on Jacob's Ladder Center's fees, charges, and billing terms in effect as shown on Jacob's Ladder Center's payment page. You are also responsible for paying any sales and use taxes and shipping and handling fees that may apply to your purchase of products based on the address that you provide as the shipping address when you checkout, and you authorize Jacob's Ladder Center or the third party payment processing service provider that we engage to charge your credit card for any such taxes and fees. All payments shall be made by credit card in advance prior to shipping products. If you do not pay on time or if your credit card cannot be charged for any reason, Jacob's Ladder Center reserves the right to either suspend or terminate your account and recurring donation(s) and terminate these Terms of Service. All sales and payments will be in US Dollars.

Jacob's Ladder Center's third party payment service provider may receive updated credit card information from your credit card issuer. The disbursement of the updated credit card information is provided to Jacob's Ladder Center and Jacob's Ladder Center's third party payment service provider at the election of your credit card issuer. Neither Jacob's Ladder Center nor Jacob's Ladder Center's third party payment service provider is responsible for the distribution of your credit card information. It is at the sole election of your credit card issuer. Your credit card issuer may give you the right to opt out of the update service. It is your responsibility to contact your credit card issuer with regards to your right to opt out of the update service.

IMPORTANT NOTICE TO CONSUMER:

RECURRING DONATION CHARGES WILL BE AUTOMATICALLY CHARGED TO YOUR CARD ON FILE BASED ON YOUR SELECTED FREQUENCY.

We will automatically charge your credit card based on the frequency you have selected (i.e. every 1, 2, 3 or 4 years), as authorized by you by selecting your desired frequency demonstrating your consent to automatic payments.

RECURRING DONATION CANCELLATION:

To cancel or suspend, please contact Jacob's Ladder at 770-998-1017 and have your contact information ready. If you have any problems, please email jaclynr@jacobsladderschool.net.

Shipping and Product Acceptance

Shipping dates are estimates only. All shipments are typically sent USPS Ground. The risk of loss and title for all products purchased via the Site pass to the customer upon delivery of the item to the carrier.

Jacob's Ladder Center reserves the right to suspend, disqualify or terminate any customer's or prospective customer's participation in recurring donations and forfeit any credits earned if the customer or prospective customer is found to have engaged in any prohibited conduct or otherwise violated the provisions of these Terms of Service. If customers have engaged in prohibited conduct or fraudulent or suspicious behavior that undermines or affects the integrity or credibility of the program, and we are unable to find a solution to restore the integrity and credibility of the program, then we may in our sole discretion cancel, change or suspend the recurring donation.

Jacob's Ladder Return Policy

Items shipped from Jacob's Ladder can be returned within 30 days of receipt of the order in most cases. Some products may have different policies or requirements associated with them. The customer is responsible for return shipping on all purchased items. Jacob's Ladder does not allow exchanges at this time. Items purchased during the Holiday season may be returned as outlined below.

Holiday Return Policy

Merchandise purchased between November 1, 2016 and December 31, 2016 may be returned until January 31, 2017, for a full refund. Customers should be aware that returns may take longer to receive during the holiday season.

Fine Art

Fine Art items with a value of $75 or more must be returned using a trackable shipping method. Items carrying a value more than $500 must also be insured. All product packaging (boxes etc.) and certificates of authenticity and appraisal must be returned along with the item. Please photograph Fine Art prior to sending the return, for your record of proof.

Refund Policy

Items returned within 30 days of the order that are in original condition are eligible for a full refund. The following schedule outlines Jacob's Ladder's Partial Refund Policy for items categorized under the following:

If you Return Items in original condition past the 30-day return window

You will Receive 80% of item's price

If you Return Items that are damaged, missing parts, not in original condition or have sustained obvious signs of use for reasons not due to Jacob's Ladder's error

You will Receive Up to 50% of item's price

The method of refund will match the method of payment submitted for the item.

Donors to Jacob's Ladder may request a refund if the value of the donation does not match the intended amount. A request must be sent within 30 days of the original refund to receive the full requested amount. Requests may be forwarded to: billing@jacobsladderschool.net. Once a refund is processed by Jacob's Ladder, the client will receive a credit via the same medium as the original donation. For example, if a donor submitted a credit card payment, Jacob's Ladder would apply a credit to that account.

Delivery Method & Timing

Jacob's Ladder employs UPS, United Parcel Service, as the carrier for delivering all items. Unless otherwise selected by the customer for a market-based fee, Jacob's Ladder will ship all merchandise via UPS Ground. Most items should arrive within 5-10 business days of the purchase date within the Contiguous U.S.

ALL CONTENT IS SUBJECT TO CHANGE AND IS PROVIDED TO YOU "AS IS" WITHOUT ANY WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NONINFRINGEMENT. Please note that some jurisdictions may not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you. Without limiting the foregoing, Jacob's Ladder Center neither warrants nor represents that your use of any Content will not infringe the rights of any third parties nor that the Content will be accurate, complete or up-to-date. Additionally, with reference to any discussions, chats, postings, transmissions, bulletin boards, and the like that may be on the Site, Jacob's Ladder Center assumes no responsibility or liability arising from any infringing, threatening, false, misleading, abusive, harassing, libelous, defamatory, vulgar, obscene, scandalous, inflammatory, pornographic, or profane material or any material that could constitute or encourage conduct that would be considered a criminal offense, give rise to civil liability, or otherwise violate any law, contained in any such locations on the Site.

Exclusion of Liability

YOUR USE OF THE SITE IS AT YOUR OWN RISK.
